Oroville Sewer Backup Case Lessons Learned and a CA Supreme Court Decision

In the case of City of Oroville v. Superior Court (2019) 7 Cal.5th 1091, the California Supreme Court overturned prior case law that effectively imposed inverse condemnation liability (including damages, attorney fees and expert costs) on public agencies for sewer backup claims.  Agencies still face tort claims for “dangerous condition of public property,” with its elements and defenses, and could still face inverse condemnation claims under the limited circumstances of a showing that an agency deliberately adopted a “fix it when it breaks” plan of maintenance.  We will discuss the Oroville case and potential legal defenses to claims.

Introduction to Risk Pools and Captive Insurance Companies

A captive insurance company can reduce and stabilize long-term insurance costs and ensure access to insurance coverage needed to sustain key operational functions. In addition, a captive earns investment income net of losses and expenses. The captive can utilize the underwriting profits, expand investments opportunities, and allocate income as needed. 

A captive provides the flexibility to adjust risk retention strategies in response to market cycles or changes in exposures. This puts the captive at the core of a risk manager’s toolbox to address both traditional and untraditional insurance risks.

Goodbye Infiltration and Inflow 

Infiltration and Inflow (I&I) of surface and ground water into the sewer system is a major problem for sanitation agencies resulting in claims and public perception issues from spills and backups, as well as the need for potentially costly infrastructure oversizing.  The purpose of this session is to share lessons learned from 40 years of fighting I&I at the Truckee Sanitary District.  Topics will include I&I measurement and analysis, but will focus on control strategies.  TSD was recently awarded the 2021 WEFTEC Operator Ingenuity Award for a new I&I reduction product, a manhole sealant/lubricant, it developed in partnership with a manufacturer that could help many agencies reduce their I&I, as well as having the ancillary benefit of improving worker safety.
